PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THE AMERICAN CRYPTO INVESTMENT PLATFORM. BY ACCESSING OR USING OUR PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS OF USE.

  1. INTRODUCTION

These terms and conditions of use (“Terms”) govern your use of the American Crypto Investment platform (“Platform”) offered by American Crypto Investment, LLC (“Company”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.

  1. USE OF PLATFORM

The Platform allows users to buy, sell, trade, and hold various cryptocurrencies, as well as engage in options trading. The Platform is intended for use by individuals who are at least 18 years of age and legally able to enter into binding contracts.

By using the Platform, you represent and warrant that you have the legal capacity to enter into these Terms, and that you will comply with all applicable laws, rules, and regulations in connection with your use of the Platform.

  1. ACCOUNT REGISTRATION AND VERIFICATION

In order to use the Platform, you must register for an account and provide accurate and complete information as requested. You agree to keep your account information up-to-date and accurate at all times.

The Company may require you to undergo a verification process in order to use certain features of the Platform, such as options trading. You agree to provide any information and documentation requested by the Company in connection with the verification process.

  1. SECURITY

You are responsible for maintaining the confidentiality and security of your account information, including your username and password. You agree to notify the Company immediately if you become aware of any unauthorized use of your account or any other breach of security.

The Company is not liable for any loss or damage arising from your failure to comply with these security obligations.

  1. BUYING, SELLING, TRADING, AND HOLDING CRYPTOCURRENCIES

The Platform allows you to buy, sell, trade, and hold various cryptocurrencies. The Company does not guarantee the availability, accuracy, or completeness of any cryptocurrency offered on the Platform.

The Company reserves the right to suspend or terminate your account or restrict your access to the Platform at any time and for any reason, including if it suspects fraudulent or illegal activity or a violation of these Terms.

  1. OPTIONS TRADING

The Platform allows you to engage in options trading. Options trading involves significant risk and is not suitable for all investors. You should carefully consider your investment objectives, level of experience, and risk tolerance before engaging in options trading.

By engaging in options trading on the Platform, you represent and warrant that you have the necessary knowledge and experience to understand the risks involved and that you will comply with all applicable laws, rules, and regulations in connection with your options trading activities.

  1. NO REFUNDS

The Company does not offer refunds for any transactions or activities conducted on the Platform. All transactions and activities are final.

 

  1. User Conduct You agree to use our Services only for lawful purposes and in accordance with this Agreement. You are solely responsible for any and all acts and omissions that occur under your account or password, and you agree not to engage in any unacceptable use of the Services. Unacceptable use includes, but is not limited to:

(a) Using our Services to engage in any form of illegal activity, including money laundering or terrorist financing;

(b) Interfering with, disrupting, or attempting to gain unauthorized access to other accounts, networks, or computer systems;

(c) Impersonating any person or entity or providing false or misleading information;

(d) Using automated systems or software to extract data from our Services;

(e) Engaging in any conduct that restricts or inhibits any other user from using or enjoying our Services;

(f) Posting, transmitting, or disseminating content that is unlawful, threatening, abusive, harassing, defamatory, obscene, or that promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual;

(g) Using our Services in any way that could damage, disable, overburden, or impair our servers or networks;

(h) Encouraging or enabling any other individual or entity to engage in any of the activities prohibited under this section.

  1. Age Requirements Our Services are intended for individuals who are 18 years of age or older. By using our Services, you represent and warrant that you are at least 18 years old. We do not knowingly collect personal information from individuals under 18 years of age. If you become aware that an individual under 18 years of age has provided us with personal information without the consent of his or her parent or legal guardian, please contact us immediately.

  2. Security We use commercially reasonable efforts to ensure the security of our Services, but we cannot guarantee that unauthorized third parties will not be able to defeat our security measures. You acknowledge and agree that you provide information to us at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on our Services.

  3. Privacy We take the privacy of our users seriously. Our Privacy Policy is incorporated into this Agreement by reference. By using our Services, you agree to the collection and use of your information in accordance with our Privacy Policy.

  4. Intellectual Property Our Services and all of its contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by us, our licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

  5. License to Use Our Services We grant you a limited, non-exclusive, non-transferable, revocable license to use our Services for your personal use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:

(a) Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials;

(b) You may store files that are automatically cached by your Web browser for display enhancement purposes; and

(c) You may print or download one copy of a reasonable number of pages of our Services for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

  1. Fees We charge fees for certain Services. By using those Services, you agree to pay the applicable fees. All fees are non-refundable.

  2. AMERICAN CRYPTO INVESTMENT shall not be held liable for any losses, damages or expenses that you may incur as a result of any exchange rate fluctuations in connection with your use of the Platform. You acknowledge and agree that AMERICAN CRYPTO INVESTMENT has no control over the exchange rate of any cryptocurrencies, and any losses or gains resulting from fluctuations in the exchange rate of any cryptocurrency shall be your sole responsibility.

  3. You agree to indemnify and hold harmless AMERICAN CRYPTO INVESTMENT and its affiliates, officers, directors, employees, agents, and partners from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses arising from: (i) your use of the Platform; (ii) your violation of any term of these Terms and Conditions; (iii) your violation of any third-party right, including without limitation any intellectual property or privacy right; or (iv) any claim that your use of the Platform caused damage to a third party.

  4. AMERICAN CRYPTO INVESTMENT shall not be liable for any delay or failure to perform any obligation under these Terms and Conditions where the delay or failure results from any cause beyond our reasonable control, including but not limited to, acts of God, labor disputes or other industrial disturbances, electrical or power outages, utilities or other telecommunications failures, earthquake, storms or other elements of nature, blockages, embargoes, riots, acts or orders of government, acts of terrorism, or war.

  5. These Terms and Conditions constitute the entire agreement between you and AMERICAN CRYPTO INVESTMENT regarding your use of the Platform and supersedes all prior or contemporaneous communications, whether electronic, oral, or written, between you and AMERICAN CRYPTO INVESTMENT regarding your use of the Platform.

  6. These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, without giving effect to any principles of conflicts of law. You agree to submit to the exclusive jurisdiction of the federal or state courts located in New York County, New York for the resolution of any disputes arising out of or relating to these Terms and Conditions or your use of the Platform.

  7. If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable in any respect, such provision shall be deemed modified to the extent necessary to make it valid, legal, and enforceable, and the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired in any way
