LEGAL
INTRODUCTION
These legal terms and conditions (the “Agreement”) are a binding contract between American Crypto Investment and any user of its platform (the “User”), whether an individual or a business entity. By accessing the American Crypto Investment platform and using its services, the User agrees to be bound by this Agreement.
DEFINITIONS
The following terms used throughout this Agreement shall have the following meanings:
a) “American Crypto Investment” refers to the company offering the platform.
b) “User” refers to the person or entity accessing the platform and using its services.
c) “Platform” refers to the American Crypto Investment trading platform, which allows Users to buy, sell, hold, trade futures and options, and manage their cryptocurrency assets.
RISKS
Users of the American Crypto Investment platform should be aware that trading and holding cryptocurrency assets involves significant risk, including the potential for loss of the entire investment. The value of cryptocurrency assets can be highly volatile and can fluctuate dramatically in short periods of time.
ELIGIBILITY
Users of the American Crypto Investment platform must be at least 18 years of age and have the legal capacity to enter into this Agreement. Users are responsible for ensuring that they are not prohibited by any applicable law or regulation from accessing or using the platform.
COMPLIANCE WITH APPLICABLE LAWS
Users of the American Crypto Investment platform are responsible for complying with all applicable laws and regulations in their jurisdiction, including but not limited to tax, anti-money laundering, and securities laws.
Third-Party Funds Management
American Crypto Investment is authorized to manage funds on behalf of third parties, including but not limited to discretionary investment management services. You acknowledge that the investments made by American Crypto Investment on your behalf may be subject to market risks and that American Crypto Investment cannot guarantee returns on your investments. American Crypto Investment will exercise due diligence in managing such funds but will not be responsible for any losses that may arise from such investments.
Compliance with Laws and Regulations
You acknowledge that you will comply with all applicable laws and regulations regarding the use of the American Crypto Investment platform, including but not limited to tax laws, financial reporting laws, and anti-money laundering regulations. You agree to provide accurate and complete information to American Crypto Investment, and you will not use the platform for any illegal or unauthorized purpose.
Changes to Terms and Conditions
American Crypto Investment reserves the right to amend these terms and conditions at any time, and such changes will be effective immediately upon posting on the American Crypto Investment website. Your continued use of the American Crypto Investment platform after such changes will constitute your acceptance of the amended terms and conditions.
Termination
American Crypto Investment may terminate your access to the platform at any time without notice and for any reason, including but not limited to your violation of these terms and conditions or any applicable laws and regulations.
Indemnification
You agree to indemnify and hold harmless American Crypto Investment and its affiliates, officers, directors, employees, agents, and partners from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the American Crypto Investment platform, your violation of these terms and conditions, or your violation of any law or the rights of a third party.
Limitation of Liability
In no event shall American Crypto Investment or its affiliates, officers, directors, employees, agents, or partners be liable to you or any third party for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your use of the American Crypto Investment platform, including but not limited to damages for lost profits, loss of data, or business interruption, even if American Crypto Investment has been advised of the possibility of such damages.
LIABILITY
American Crypto Investment will not be liable for any damages or losses resulting from your use or inability to use the Platform, including but not limited to indirect, consequential, incidental, punitive, or exemplary damages. We will not be liable for any losses or damages resulting from a Force Majeure event, any act or omission by a third-party service provider, or any unauthorized access to or alteration of your data or transmissions.
INDEMNIFICATION
You agree to indemnify and hold American Crypto Investment, its affiliates, directors, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys’ fees, arising out of your use of the Platform, your violation of these Terms and Conditions, or your violation of any rights of another user or third-party.
DISPUTE RESOLUTION
These Terms and Conditions will be governed by and construed in accordance with the laws of the State of California without giving effect to any principles of conflicts of law. Any dispute arising out of or related to these Terms and Conditions or your use of the Platform will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
TERMINATION
American Crypto Investment reserves the right to terminate or suspend your access to the Platform at any time without notice for any reason, including but not limited to your violation of these Terms and Conditions or any applicable law.
MODIFICATION
We reserve the right to modify these Terms and Conditions at any time without notice. Your continued use of the Platform after any changes to these Terms and Conditions will constitute your acceptance of such changes.
SEVERABILITY
If any provision of these Terms and Conditions is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
ENTIRE AGREEMENT
These Terms and Conditions constitute the entire agreement between you and American Crypto Investment regarding the use of the Platform and supersedes all prior agreements and understandings, whether written or oral.
